MARU VOICE CANADA SWEEPSTAKES

 

1.         HOW TO ENTER

 

The Maru Voice Canada Sweepstakes is sponsored by Maru/Blue Canada Inc. (the “Sponsor”). The Sweepstakes will be available online at maruvoice.ca beginning on April 30, 2018 at 12:00:01 am Eastern Time (“ET”) and ending on May 31, 2018 at 11:59:59 pm ET (the “Sweepstakes Period”). Void where prohibited or restricted by law.

 

To enter the Sweepstakes, entrants must do any one (1) of the following:

 

A.         Follow the password reset instructions sent to you via email by the Sponsor on April 30, 2018;

 

B.         Respond to any survey invitation received from the Sponsor during the Sweepstakes Period; or

 

C.         Visit maruvoice.ca, click the “reset my password” link and follow the password reset instructions posted on-screen.  

 

In the event of a dispute regarding an entry, the entry will be deemed to have been made by the “authorized account holder” of the e-mail address submitted at the time of entry.  The “authorized account holder” is the person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail address.

 

All entries into the Sweepstakes must be received by no later than 11:59:59 PM ET on May 31, 2018.

 

Odds of the winning the Grand Prize or any Secondary Prize depend on the number of non-winning eligible entries received immediately prior to each random drawing.

 

2.         ELIGIBILITY

 

To be eligible to enter and win in this Sweepstakes, entrants must be residents of Canada who are 18 years of age or older, have reached the age of majority in their province or territory of residence at the start of the Sweepstakes Period, and who are members of Maru Voice Canada as of April 30, 2018 at 12:00:01 am ET.  To be eligible to win the Grand Prize, entrants must also possess a valid driver’s license (equivalent to a “G” class license in the Province of Ontario) issued by a Canadian province/territory.  Entrants are not eligible if, at any point during the Sweepstakes Period they are (or they live or are otherwise domiciled with) an employee, representative or agent of the Sponsor.  Only one (1) entry per person into the Sweepstakes is permitted.

 

3.         PRIZES:

 

A.         GRAND PRIZE:  There is one (1) Grand Prize available to be won, consisting of a 2017 Fiat 500 POP Hatchback (red in colour) with Customer Preferred Package, 6-speed automatic transmission, air conditioning, 1.4litre/I-4 engine, and cloth bucket seats (the “Grand Prize”).  The Grand Prize has an approximate retail value of CAD$22,000 and will be awarded by random drawing to one (1) eligible selected entrant.  The winner is responsible for all expenses not included in the Grand Prize description above, including but not limited to: licensing, insurance, registration, and all other costs incurred in claiming, registering or using the Grand Prize.  Specifically, fuel, freight, administration, PDI, tire stewardship, excise taxes, OMVIC (or equivalent, if applicable), Ride Green (or equivalent, if applicable), and wheel lock charges and fees are the sole responsibility of the Grand Prize winner. Any additional options associated with the Grand Prize not specified herein are subject to availability and any payment associated with such option(s) is the sole responsibility of the Grand Prize winner.  The Grand Prize winner will be responsible for taking delivery of the Grand Prize at Downsview Fiat Chrysler (if the winner is located in Southern Ontario) or an agreed-upon location near the winner’s residence in any of the following Canadian cities: Vancouver, Calgary, Edmonton, Saskatoon, Regina, Winnipeg, Ottawa, Montreal, Quebec City, Moncton, Halifax, Charlottetown, Saint John (New Brunswick), or St. John’s (Newfoundland and Labrador). 

 

The Grand Prize is non-exchangeable, non-transferable, non-refundable, has no cash surrender value, and must be accepted as awarded with no substitutions.  Other than in the Sponsor’s sole discretion, the Grand Prize winner is not permitted to choose between the Grand Prize and the cash equivalent of the Grand Prize.  The winner should allow 8-10 weeks for the delivery of the Grand Prize. To receive the Grand Prize, the winner must meet all Sweepstakes’ eligibility requirements and possess satisfactory (in the Sponsor’s sole determination) proof of insurance.

 

B.         SECONDARY PRIZES:  There are twenty five (25) Secondary Prizes available to be won, each consisting of CAD$100 in retail gift cards (each a “Secondary Prize”). Redemption of Secondary Prize retail gift cards will be governed by such terms and conditions as may be determined by the gift card issuer, in its sole discretion.

 

All trade-marks related to the Grand and Secondary Prizes in this Sweepstakes are the property of their respective owners and no sponsorship, endorsement or affiliation with Sponsor, its products or this Sweepstakes is implied by their use or reference.

 

Limit of one (1) Grand or Secondary Prize per person or household.  The Sponsor may, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification in the event of unavailability for any reason of the advertised Grand Prize or Secondary Prizes or any portion thereof. The Sponsor accepts no liability or responsibility for any loss incurred by the Grand or Secondary Prize winners or any third party if the Grand or Secondary Prize or any portion thereof is unavailable or substituted for any reason.

 

4.         PRIZE DRAWINGS

 

A random drawing to award the Grand Prize and the Secondary Prizes (the Grand Prize entrant will be selected first, followed by the Secondary Prize selected entrants) will be held at the offices of the Sponsor, 900 West Hastings Street, Suite 600, Vancouver, British Columbia, V6C 1E5, on June 1, 2018 at 10:00 am ET from among all eligible entries received.  The selected entrants will be contacted by email, phone or mail, and, in order to be declared a winner, must first correctly answer, unaided, at a mutually convenient time, a mathematical skill-testing question, sign and return (within 14 days of receipt) the Sponsor’s declaration and release form, and otherwise comply with these Official Rules (“Rules”).  If a selected entrant declines the Grand Prize, incorrectly answers the skill testing question, cannot be located, does not return the declaration and release within 14 days of receipt, or otherwise does not comply with these Rules, the entrant forfeits the Grand Prize, and the Grand Prize will be awarded by the Sponsor to an alternate, eligible randomly selected entrant in the manner described above.

 

5.         RELEASE OF LIABILITY

 

By entering, all participants agree to release and hold harmless Sponsor, and Sponsor’s parent company, affiliates, subsidiaries, and the officers, directors, agents and employees of each of the foregoing, and all others associated with the development and execution of this Sweepstakes from and against any and all liability with respect to, or in any way arising from or in connection with, participation in this Sweepstakes and/or the acceptance, possession  or use of the Grand Prize, a Secondary Prize or any portion thereof that may be awarded to them, including, but not limited to, liability for personal injury, bodily injury, death, damages or loss of any kind. By accepting a Grand or Secondary Prize, each winner acknowledges and agrees that the Sponsor, and Sponsor’s parent company, affiliates, subsidiaries, and the officers, directors, agents, employees of each of the foregoing, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Grand or Secondary Prize or any portion thereof, including without limitation, its quality, mechanical condition or fitness for a particular purpose.

 

6.         GENERAL

 

Neither Sponsor nor its agents are responsible for: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, undelivered, inaccurate or not received by Sponsor for any reason; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries; (iii) destruction of or unauthorized access to, or alteration of, entries; or (iv) failed or unavailable hardware, network, software or telephone transmissions, damage to participant’s or any person’s computer and/or its contents, or any other causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes, or the odds of winning.  All incomplete entries will be disqualified.  Sponsor and its agents are further not responsible for: (v) incorrect or inaccurate entry or Grand or Secondary Prize claim information whether caused by participant or by any of the equipment or programming associated with or utilized in the Sweepstakes, or for any other errors of any kind, whether technical, network, printing, typographical, human or otherwise, in any Sweepstakes-related materials or in the announcement of prize/prizewinner; or (vi) misrepresentation, cheating or fraud by any participant. If any of the foregoing malfunctions, errors, defects or acts render the Sweepstakes incapable of operating as planned, Sponsor, at its sole discretion and with the consent of the Régie des alcools, des courses et des jeux (the “Régie”) in the Province of Québec, may suspend or terminate this Sweepstakes immediately and select the winner(s) in an alternate random drawing from all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor, or in any other manner deemed fair and equitable by Sponsor. All entries become the exclusive property of the Sponsor and will not be returned or acknowledged except as provided herein. Any attempts by an individual to access the site via a bot script or other brute-force attack will result in that individual’s e-mail address becoming ineligible, and the entry/entries submitted by that e-mail address becoming void. If Sponsor, in its sole discretion, determines that an individual is tampering or attempting to tamper with the Sweepstakes or any Sweepstakes website, such individual will be disqualified.  Furthermore, in the event it is determined that an entrant has submitted more than the number of entries permitted by these Rules, the entrant will be disqualified and all of the entries submitted by the entrant will be disqualified.  Sponsor reserves the right, with the consent of the Régie in Québec, to suspend or terminate this Sweepstakes without notice if, in Sponsor’s sole discretion, the Sweepstakes becomes infected or otherwise corrupted or if the Sweepstakes otherwise cannot operate as planned; in such event, Sponsor will select winner(s) in a random drawing from among all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor, or in any other manner deemed fair and equitable by Sponsor.

 

CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

By entering this Sweepstakes, participants agree to be bound by these Rules and the decisions of the Sponsor with respect to all aspects of the Sweepstakes, which shall be final, binding and conclusive on all matters relating to this Sweepstakes.  No correspondence will be entered into except with the selected entrants.

 

The Sponsor accepts no responsibility for losses, damages or claims caused by or resulting from the Sweepstakes or the Grand Prize of Secondary Prizes associated with this Sweepstakes. By entering and accepting the Grand Prize or a Secondary Prize, the winner consents to the use of his/her name, address (town/city and province/territory), entry and/or photograph without further remuneration or notice, in connection with any publicity carried out by or on behalf of the Sponsor with respect to this Sweepstakes or the Grand or Secondary Prize, as applicable.

 

7.         PRIVACY

 

Any information collected during the course of this promotion will be used only for purposes of this Sweepstakes and only in a manner consistent with Sponsor’s Privacy Policy, available at https://www.marublue.net/privacy/.

 

8.         QUEBEC RESIDENTS

 

Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
